Jana Pawła II 9, 50-136 Wrocław, entered into the Register of Entrepreneurs maintained by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Department of the National Court Register, under the numbers: KRS 0000522956, NIP 8971801362, REGON 022495473, and its subsidiaries   or the services they make available, particularly those provided by companies from SOFTJOURN group (Softjourn-Ukraine, LLC, legal person duly established and acting in accordance with the legislation of Ukraine, with its registered address at 32/74 Berehova Str., 76018 Ivano-Frankivsk, Ukraine, Softjourn INC., a California corporation, with its principle place of business at 39270 Paseo Padre Pkwy, Suite 251, Fremont, CA 94538, USA), (together the “SOFTJOURN” for the purposes of this Privacy Policy as appropriate)

 

§ 2 Information about the personal data controller

Jana Pawła II 9, 50-136 Wrocław, entered into the Register of Entrepreneurs maintained by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Department of the National Court Register, under the numbers: KRS 0000522956, NIP 8971801362, REGON 022495473, is the controller of your personal data as described by the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”).

§ 4 Purposes and legal grounds for personal data processing

We process your personal data for the purposes indicated below, on the basis of legitimate interest of SOFTJOURN POLSKA Spółka z o.o., which includes:
-    providing answers to questions / messages sent by you;
-    conducting statistical analyses.
If we obtain your permission, we process your personal data in order to:
-    contact you, including for purposes related to permitted marketing activities, through available communication channels, in particular by e-mail and telephone,
-    send commercial information by means of electronic communication;
Using our website does not require providing personal data, but without providing your data we are not able to answer your question.
You can withdraw your consent to the processing of personal data concerning you at any time, in the same way in which you have expressed it. We will process your personal data until you have withdrawn your consent.

 

§ 5 The scope and method of processing information, including personal data

While you use our Website, we come into possession of information partially sent automatically by web browsers. This information is needed to ensure the proper functioning of the Website and to enable you to use it, in particular to maintain the services provided to you, improve the Website and comply with safety and legal requirements. In addition, it is needed to compile statistics and perform analytical research using Google Analytics, Lucky Orange, Finteza, Facebook Pixel, Linkedin Insight, Youtube tracking, Vimeo Tracking, MS Dynamics tracking. We share your personal data only when it is necessary for the proper provision of services to you and, within the limits of generally applicable law, to entities guaranteeing the security of personal data processing. We may share your personal data with: entities processing personal data on our behalf, in particular: subcontractors in the customer service process; traders
involved in the sale of our services; entities maintaining or providing us with ICT systems; entities conducting postal or courier activities that are not postal operators; advertising agencies; entities providing consultancy services to us, including legal ones.
If required to do so by law, your personal data may be disclosed to entities authorised under the law, including courts and prosecutors. We care about your privacy and never sell personal data.

 

§ 8 Personal data storage period or criteria for determining this period

Then, depending on the content of your request: We will provide you with confirmation whether we process your personal data, enable you to access them, or provide you with a copy of the data being processed; We will rectify incorrect data or supplement incomplete data; In situations specified in the law on the protection of personal data and to the extent indicated therein, we will also exercise your rights to:
-    erase your personal data;
-    restrict the processing of personal data;
-    transfer personal data;
-    object to the processing of personal data.
If the processing of your personal data is based on your consent, you can withdraw this consent at any time. We provide answers within 30 days from the date of receiving your request. We will inform you if, due to the complex nature of your request or the number of requests we have received, we will be forced to extend this period by up to a maximum of two consecutive months. Each time we ask you to provide data that will enable us to identify you, so as not to disclose information about you to unauthorised persons.

 

§ 10 Right to lodge a complaint with a supervisory authority

We make every effort to ensure that the processing of your personal data is carried out in a manner consistent with the provisions of law. However, if you believe that we have committed a violation, you have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office.

- to contact you by phone, under the telephone number you have voluntarily provided, in order to present the commercial offer of our products and services (if you have consented to this);
- demonstrate that you have agreed to the processing of your personal data and record the time when your telephone number was provided to us. Therefore, we collect information about the date, time and the IP address of the computer from which your phone number was provided to us (to fulfil our legal obligations);
4. We will process your personal data for the period of proceedings and for the period of possible claims, beginning on the day on which our representative will contact you, and in the case of data processed on the basis of your consent – until it is withdrawn, unless there is a dispute about the lawfulness of data processing, in which case we will process your data until the dispute is settled.
5. You have the right to access and rectify your data. Moreover, in situations specified by the law on the protection of personal data and to the extent indicated therein, you have the right to have your data erased or limit their processing; the right to transfer your personal data; and the right to object to the processing which we carry out to pursue our legitimate interests.
